User Agreement
Definition
“Creative Marketing Experts”: Refers to Creative Marketing Experts, a company engaged in the business of online advertisements and other advertising services.
“User”: Refers to any Creative Marketing Experts / Partnership / LLP / Individual that wishes to avail of the services from Creative Marketing Experts for its own personal or business use.
Uses Policy
- We are not responsible for any copyrighted material, images, text, or promotional material used in digital promotion.
- After discontinuing work with our agency, we are not responsible for any legal compliance of the client.
- Clients must check all images, text, and content at the time of website delivery. The final deadline for checking is 45 days from the date of website delivery.
Cognizance of this Agreement
Every user transacting any services or otherwise dealing with Creative Marketing Experts shall be deemed to have read, understood, and accepted the terms and conditions of this User Agreement and the special policies and agreements. They shall be bound by these terms as amended from time to time.
Creative Marketing Experts is entitled to amend this Agreement and any special policies and agreements as it deems fit without prior notice. The amended user agreement shall be binding.
Subject Matter
This Agreement covers the general terms and conditions for use and performance of Creative Marketing Experts.
Payment Policy
The user agrees to pay and consents to Creative Marketing Experts charging a fee/commission for the respective services. This fee may be deducted from the charges paid by the user.
Creative Marketing Experts uses the services of PYTM and TEZ for receiving payment transactions, ensuring security and authenticity. Any liability due to deficiency in services or misappropriation by the payment gateway shall be borne by the said independent payment gateway.
User Information & Declarations
All transactions through Creative Marketing Experts are subject to the information provided by the user. If any information is found to be false, misleading, or incorrect, Creative Marketing Experts is entitled to terminate the use of the account and conduct investigations.
Users must retain their user IDs and passwords. Creative Marketing Experts shall not be liable for any loss of user ID or password but may assist in retrieving or creating new ones if informed.
Users agree to allow Creative Marketing Experts to use their contact numbers and email addresses for confirmations, feedback, and promotions of Creative Marketing Experts’ products and services, as well as those of its group companies.
Creative Marketing Experts may request additional information for Know Your Customer norms or to provide better services.
User Limitation Guideline
Services are exclusively for end users unless specifically permitted. Creative Marketing Experts reserves the right to cancel transactions meant for trading or other purposes.
Creative Marketing Experts may cancel accounts and terminate contracts, and claim damages for unsolicited, mala fide, or dishonest transactions.
All data and information on Creative Marketing Experts’ website is the exclusive property of Creative Marketing Experts. Unauthorized copying, recording, or use of this data is prohibited and may result in damages and legal action.
Limitations to Performance and Liability
Creative Marketing Experts does not guarantee specific results or business calls through its products and packages.
The performance of Creative Marketing Experts’ services is limited to providing advertisement space and account activation. Creative Marketing Experts is not liable for losses due to viruses, malware, or other risks.
Creative Marketing Experts is not responsible for nonperformance due to changes in law, government policies, network failures, labor unrest, blackouts, strikes, or acts of God.
If Creative Marketing Experts is deficient in its services, liability is limited to the amount remaining unutilized and the service charges received.
Indemnification
Users must indemnify Creative Marketing Experts against any liability arising from false or fictitious representations and advertisements. Creative Marketing Experts has the right to seek indemnification for losses or liability due to user actions.
Creative Marketing Experts may levy taxes and cesses as required by government authorities, whether retrospective or prospective.
Graphics
Creative Marketing Experts provides the best graphic designs using images available on Google or other websites. Creative Marketing Experts is not responsible for any legal challenges, financial penalties, or legal actions arising from the use of these images.
Forfeiture of Digital Assets
- In the case of continued non-payment, and after written notice of overdue payment has been provided, Creative Marketing Experts may:
a. Website: Creative Marketing Experts reserves the right to temporarily disable or restrict access to the client’s website or any digital properties developed or maintained by Creative Marketing Experts until the outstanding payments are received.
b. Google My Business Page and Social Media Pages: Creative Marketing Experts may revoke access and management of the client’s Google My Business page and social media accounts, which were under the management or influence of Creative Marketing Experts until payment is received in full.
